The Produce Marketing Association (PMA) respects the privacy of its members and other visitors to its Web site. PMA strongly believes that if electronic commerce and online activities are to flourish, visitors must be assured that information provided online is used responsibly and appropriately. PMA does everything it can to keep all information from our online visitors as secure as possible against unauthorized access and use. All information is protected by PMA security measures, which are periodically reviewed. To protect online privacy, PMA has implemented the following policy.

What Information Does PMA Collect?

Most information that PMA collects is used only to help us better serve our members. It is our general policy to collect and store only personal information that our members and visitors knowingly provide. Personal information may include name, title, company, address, phone number, etc. We collect this information to grant you access to restricted content of our site and/or for your purchase of PMA products and services. The personal information we collect is only used by us to process an order or inquiry and/or for marketing our products, events, and services. While we do not sell, rent, transmit personal financial information or e-mail addresses to other organizations, exhibitor contact information for the purpose of promotion is published in event directories and on the PMA Web site, and is accessible to the public.

If our privacy policies change, we will notify all users by e-mail or a special announcement placed on the Web site.

From Visitors/General Users: Our Web server collects the domain names (not the e-mail addresses) of visitors to our Web site. This information is aggregated to measure number of visits, average time spent on the site, pages viewed, etc. PMA uses this information to measure the use of our site and to improve the content of our site.

From PMA's Members, Event Registrants & Other Customers: To gain access to members-only resources and personalization features on the site, members and other users are asked to register and provide some limited information. This information is submitted voluntarily. PMA asks users to provide their name, member number (for members), organization name, job title and/or function, business phone, and e-mail. Similar information may be submitted to PMA through membership applications, conference or event registration, product orders, subscriptions, and contest registrations.

Additionally, for some e-mails sent in HTML format by PMA to its members through its communications and e-newsletters, we will collect specific information regarding what the recipient does with that email. For those emails, PMA monitors whether a recipient subsequently clicks through to links provided in the message. Other information collected through this tracking feature includes: email address of a user, the date and time of the user's "click," a message number, name of the list from which the message was sent, tracking URL number and destination page. PMA only uses this information to enhance its communications effectiveness and the effectiveness of its products and services and distribution of those products and services to its members. This information is not sold or distributed in any other manner.

How Does PMA Use the Data Collected?

PMA uses information voluntarily submitted by members and other customers in the following ways:

PMA Member Offerings/Programs: Generally, PMA uses data collected to improve its own Web content; to respond to visitors' interests, needs and preferences; to improve communications and distribution of those communications and to develop new programs, products and services.

Disclosures to Third Parties: PMA also makes member contact information available through the PMA Membership Directory to other members using its Web site and to those who register for its conferences. Members, event participants, and users may request that PMA refrain from disclosing the data it collects on the membership application form, conference registration form or any other form on which they are providing information. Consent to Use Personal Information: For the purposes of the Data Protection Act(s) 1984 and 1998 (as applicable), PMA or its agents must store, host and otherwise process the information (including personal data) supplied by the User when registering for this Web site. PMA may send such data outside the European Economic Area for processing. If you reside in the European Union, please indicate your consent that the personal information you have provided may be transferred and stored in countries outside of the EU, including the United States. User supplies as defined above when registering for the Web site in order to allow PMA (or its designated agents) to use the information to send the User unsolicited direct mail advertisements, promotions, and solicitations for third parties' products and services.

Credit Card Account Information: PMA does not disclose credit card account information provided by its members and customers. When members and customers choose to pay using their credit cards, PMA submits the information needed to obtain payment to the appropriate clearinghouse.

How Does PMA Use Cookies?

Cookies are files that contain information created by a Web server that can be stored on a User's hard disk for use either during a particular session ("per-session" cookie) or for future use ("persistent" cookie). PMA uses cookies only to facilitate automated activity, store and track passwords, determine appropriate solicitations, and review navigation patterns. Cookies are not used to disseminate significant information about users over the Web or to analyze any information that users have knowingly or unknowingly provided. When a user registers, the system will ask whether the user approves of the attachment of a cookie. Users may instruct their Web browsers to opt out of accepting a "persistent" cookie and rather accept only a "per-session" cookie, but will need to login each time they visit the site to enjoy the full benefits. If the user declines the attachment of any cookie, the user may not have access to the full benefits of the Web site. Registration enables the site to better determine members' interest areas and provide the most relevant information.

PMA collects cookies on our Web site to capture information about page visits. This information is anonymous and PMA uses this information only internally - to deliver the most effective content to our visitors. Information from the cookies is used to gauge page popularity, analyze traffic patterns on our site and guide development of other improvements to our site. PMA does not require that you accept cookies, however, some functionality on our Web site, our product or service check-out process, and products and services may be disabled if you decline to accept cookies. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. You may also change your cookie settings through preferences options in our products and/or services, where applicable. PMA never gives away information about our users. If you choose to e-mail us and provide personally identifiable information about yourself, PMA will use this information only to respond to your inquiry. PMA will not sell, rent or otherwise disclose that information to third parties unless such disclosure is necessary for the purposes set forth in this Policy, by law or a policy or notice contained or associated with a specific PMA product or service.

PMA uses analytics data and the DoubleClick cookie to serve ads based on a user's prior visits to our website.  Site visitors may opt out of the DoubleClick cookie by visiting the Google advertising opt-out page or they may opt out of Google Analytics by visiting the Google Analytics opt-out page.

E-mail Opt-Out Guidelines

PMA Provides an opportunity to opt-out of any communications it sends. While PMA sends out many types of communications it believes will benefits its members, such as a monthly newsletter, exhibitor bulletins and issue alerts regarding an unfolding industry crisis, members have the right to request to be removed from the distribution of any or all such communications. PMA includes a disclaimer at the end of every message that says:

You are receiving this message because PMA believes you will benefit from this information. If you have any concerns about mailings of this type or would like to unsubscribe, please contact Member Services.

PMA follows the Federal CAN-SPAM guidelines of 2005 and 2008. According to these guidelines, PMA will not e-mail anyone with whom it does not have an established business relationship. In addition, all commercial email messages to include certain items:
•A "valid physical postal address" for the sender of the message and identify sender and provide notification if an e-mail message is being sent on behalf of PMA
•Ensure that the email does not contain false or misleading transmission information; Ensure that the email does not include a deceptive "subject" heading;
•Include a functioning return email address or other Web-based mechanism, clearly and conspicuously displayed, that the recipient can use to make an opt-out request;
•Provide clear and conspicuous notice of the recipient's right to opt-out of receiving future commercial messages from the sender.

What Privacy Issues Arise With Links to Other Sites?

This Web site contains links to other Web sites. PMA makes every effort to only link to sites that share our high standards and respect for privacy. However, we are not responsible for the content or the privacy practices employed by other sites. Such external addresses contain information created, published, maintained or otherwise posted by institutions or organization independent of PMA. PMA does not endorse, approve, certify, or control these external Web addresses and does not guarantee the accuracy, completeness, efficacy, timeliness, or correct sequencing of information located at such addresses. Use of any information obtained from such addresses is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy, and timeliness.
